Acceptance of Terms

By accessing or using Forgepoint services, including our website, game servers, Discord server, and store, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

Age Requirement

You must be at least 16 years of age to use our services. If you are under 18 years of age, you must have permission from a parent or legal guardian who agrees to be bound by these terms on your behalf. By using our services, you represent and warrant that you meet these age requirements.

Virtual Items

All purchases are for virtual items, VIP perks, or server enhancements. These have no real-world monetary value and cannot be transferred, traded, or resold. You do not own any virtual items - you are granted a limited, non-exclusive, non-transferable, revocable licence to use them within our services. We comply with Facepunch's Community Server Guidelines for monetization.

Delivery

Items are delivered automatically within 5-15 minutes while you're connected to the server. If you don't receive your items, reach out on our Discord and we'll resolve it. We are not responsible for delivery failures caused by incorrect account linking, server unavailability, or factors outside our control.

Refunds

All purchases are voluntary donations that support the server. Sales are final and no refunds will be issued. This includes wipes, balance changes, accidental purchases, or if you stop playing. Review your order before paying. See our Refund Policy for full details.

Chargebacks

Filing a chargeback or payment dispute results in a permanent ban from all Forgepoint services and servers. This ban is enforced across all accounts and devices. If you have a problem, contact us on our Discord - we're happy to help resolve issues.

Server Rules & Termination

VIP or purchases do not exempt you from server rules. Breaking rules can result in bans without refund. We reserve the right to terminate, suspend, or restrict your access to our services at any time, for any reason, without prior notice or liability. This includes but is not limited to rule violations, suspected fraud, abusive behaviour, or any conduct we deem harmful to our community.

Ban Enforcement & Evasion

When access to our services is restricted or terminated, you must not attempt to circumvent the restriction by any means, including but not limited to creating new accounts, using different devices, changing your IP address, or using VPNs or proxies.

We employ technical measures including device fingerprinting, IP tracking, and account linking to detect and prevent ban evasion. By using our services, you acknowledge and consent to these measures. Attempting to evade a ban may result in further action and the restriction being extended to any new accounts or identifiers you use.

Service Availability

We do not guarantee that our services will be available at all times. Services may be interrupted for maintenance, updates, server wipes, technical issues, or any other reason. We may modify, suspend, or discontinue any part of our services at any time without notice. Server wipes are a normal part of Rust gameplay and do not entitle you to any refund or compensation.

Modifications to Services & Terms

We reserve the right to modify these terms, perks, pricing, virtual items, game balance, and any aspect of our services at any time without prior notice. Continued use of our services after changes constitutes acceptance of the new terms. It is your responsibility to review these terms periodically.

Facepunch DLC

We do not restrict access to any official Facepunch DLC you've purchased. If you own it on Steam, you can use it on our servers.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no guarantees regarding the reliability, accuracy, or quality of any content or services.

Limitation of Liability

To the maximum extent permitted by applicable law, Forgepoint, its owners, operators, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or £50 GBP, whichever is less.

Indemnification

You agree to indemnify, defend, and hold harmless Forgepoint, its owners, operators, staff, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of our services, your violation of these terms, your violation of any third-party rights, or any content you submit or transmit through our services.

Dispute Resolution

Any disputes arising from these terms or your use of our services shall be resolved through informal negotiation first. If a dispute cannot be resolved informally, you agree that any legal proceedings shall be conducted individually and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Forgepoint.

Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising from these terms.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, DDoS attacks, internet outages, hosting provider failures, power failures, or shortages of transportation, facilities, fuel, energy, labour, or materials.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Forgepoint regarding your use of our services and supersede all prior agreements and understandings.
